Conditions.

 1.0. About Us.

1.1 Absolute Creative Print operates from 9 - 10 Starnes Court, Union Street, Maidstone, Kent ME14 1EB with the company registered in England and Wales under the company number 07236927 and a VAT number of 989638729.

1.2 The Tonbridge branch is We Know Print T/A Absolute Creative Print and operates from 161 High Street, Tonbridge, Kent, TN9 1BX with the company registered in England and Wales under the company number 10160343 and a VAT number of 241061454.


2.0. Office Hours.

2.1 Absolute Creative Print are open 9am - 5pm, Monday to Friday, excluding Bank Holiday weekends. Telephone calls received out of hours will be diverted to our answering machine and dealt with on the next working day.

2.2 Where staff mobile telephone numbers are provided, we ask that you exercise discretion when calling out of office hours and only call in emergencies, as these are also the staff’s personal telephones. We appreciate your understanding.


3.0. Contacting Us.

3.1 The most effective way for us to deal with enquiries is either in-store (Maidstone: 9 - 10 Starnes Court, Union Street, Maidstone, Kent ME14 1EB, Tonbridge: 161 High Street, Tonbridge, Kent, TN9 1B), via email (print@absolutecp.co.uk) or through a contact form via this website as this allows us to distribute questions to the appropriate departments and therefore respond to you more efficiently.

3.2 You can also call us on Maidstone: 01622 755 522 or Tonbridge: 01732 357 872 during the usual working hours. All price and product enquiries are dealt by the sales team.

3.3  The majority of the designer/client communication is email-based, where all parties must keep track of correspondence. This enables both parties to be able to look back over emails for clarification if needed.

3.4  All quotations are provided in writing and will be sent via email before the commencement of a project. 

3.5  Changes to designs must be communicated via email so as to keep track of the project development, and for us to have the ability to refer back to the amendments when required.


4.0. Our Relationship.

4.1 After starting any job with Absolute Creative Print, you authorise the staff members to proceed with the creation of the products and services, as agreed with the sales representatives and confirmed when agreeing a quote.

4.2 Any jobs that are put on hold or are cancelled by the client during the design and/or production will be invoiced at the current state and materials used. This invoice must be paid in full.


5.0. Quotations.

5.1  All design, print and display projects will be only be commenced once a quotation has been discussed and accepted, and in some cases, a deposit paid. 

5.2  All discussions and negotiations must happen before the quotation has been agreed, unless the project requires new quotations or additional costs to be added at a later stage.

5.3  Accepting the quotation is confirmation of your commitment to the project, with the deposit to be paid in full. Cancellation after this stage may result in additional costs for time spent by Absolute Creative Print or any third parties.

5.4  Our quotations are valid for 30 days. If the quotation has not been agreed in this timeframe, it may be subject to be re-quoted.

5.5  Any work required that has not been outlined in the approved quotation will incur additional costs.  These will be discussed in writing before commencing with the extra work.

5.6  All costs will be recorded and made clear to the client in writing before proceeding.

5.7  Additional costs may include, but are not limited to:

  • Purchasing stock imagery from stock libraries

  • Purchasing fonts for the project

  • Outsourcing any third parties that have been requested to fulfil the needs of the project

  • Any specialist materials required for printing, finishing and delivery.


6.0. Proofing Agreement.

6.1 In most cases, a proof will be provided of the artwork to be printed, unless it has been supplied at the correct size, with bleed and crop marks where necessary.

6.2 It is your responsibility to check for any mistakes as these will be present on the final print. By approving this proof, you absolve Absolute Creative Print of all liability for any discrepancies that were present on the proof. Any mistakes printed after approval will incur additional costs that will be passed onto yourself.

6.3 Our standard terms and conditions revokes your right to take any kind of action against Absolute Creative Print for any aspect of the work with which you are later dissatisfied. As long as the finished product is as discussed with the sales representative and consistent with the proof supplied, you must pay for the work in full.

6.4 As stated in the email supplied with the proof, all approvals must be received via email. We are unable to accept approvals via the telephone. These terms are final and non-negotiable.

6.5 We understand that with all artwork and design jobs, changes may be made and a new proof can be supplied, which is included in the cost. However, it is down to the discretion of the designer if the changes exceed the design quote that is supplied at the beginning, and additional charges may occur. This will be discussed before any extra work is undertaken.

6.6 If a change to artwork has been requested, we will do everything we can to make the correction before printing commences. We accept no responsibility, under any circumstances, for any mistakes present on the completed work, as the signing-off of a proof via email absolves us of all liability.

6.7 If a change has requested after the material has been printed, we can re-print the files, however they will incur a plate charge, which will be passed onto yourself as part of the total charge.


7.0. Print Quality.

7.1 Where low resolution files are supplied, we will take every care to secure the best results in the finished product, but we accept no responsibility for imperfect work caused by defects from unsuitable files supplied. The design department will alert you if something is printing at a low resolution and are on hand to advise alternative options.

7.2 Every effort is made to obtain the best possible colour reproduction on work and Pantone colour references must be supplied where possible. Files that are supplied in RGB are likely to be printed slightly darker than what is on screen and where possible, we will convert this to CMYK before proceeding. We cannot guarantee an exact match in colour between the printed article and the proof supplied on screen. We are happy to provide a printed proof where possible before production if there are any concerns with the colour reproduction.

7.3 Every effort is made to produce the exact quantity of items ordered. Some variation is inherent in the print process and there are likely to be slightly more than what has originally been quoted. This is due to the printing process and it does not affect the overall cost.


8.0. Display & Installation.

8.1 Before a display project is quoted, a site visit must be conducted to assess the area, measure up and take photographs of the area.

8.2 All measurements and images will be taken by a member of staff in order for our design and production team to be as accurate as possible when setting up the files / designing / printing your order.

8.3 We will arrange a date and a time to install your order on-site - please provide as many details as possible, keeping the area free from public access as much as possible.

8.4 It is the obligation of the customer to check the structure to which the goods are to be affixed, and to prepare surfaces to which the goods may be applied, so that in each case they are suitable for such affixing and application. The customer acknowledges that following installation, they will be responsible for the inspection, maintenance and repair of the goods supplied.

8.5 Absolute Creative Print makes every effort to achieve the agreed delivery dates and cannot accept liability of be held financially responsible for any deadlines missed resulting from extenuating circumstances:

  • Content supplied to Absolute Creative Print after the agreed times

  • Other parties that are unable to fulfil their agreed delivery times

  • Act of God or any extraordinary incidents beyond the control of Absolute Creative Print, including fire, droughts or floods

  • Extreme weather conditions

  • War or acts of terrorism

  • Theft, damage or loss of equipment, documents or any items that are required to fulfil the expectations of the project

  • Failure of power supply

  • Strike action taken by persons, parties and services required to complete the work

  • Epidemics or pandemics, for example: the recent COVID-19 pandemic


9.0. Invoicing.

9.1  The client agrees to pay:

  • 50% deposit of the quoted amount in order to start the project

  • The remaining 50% is due once the project has been signed off by the client, or before files are sent to print.

9.2  Absolute Creative Print endeavour to go above and beyond for their client at all times, however if in the event a client changes their mind, or no longer wants to continue, it may incur a cancellation fee. The cancellation fee is to cover the time that has already been spent on the client, including any work that may have been undertaken.

9.3  Once the quotation has been agreed, a sales order will be created and sent to the client. Once payment of the deposit has been made, the work will commence.

9.4  If extra work is required which incur additional costs (as outlined in 5.7) Absolute Creative Print will inform the client and the costs will be added to the sales order once agreed.

9.5  Payments must be made within 30 days of the invoice date. Late payments will be subject to a 5% fee on the remaining balance, which will be added to the total sum once the 30 days has passed. This will subsequently be added for every 7 day period that goes unpaid thereafter.


10.0. Scheduling.

10.1  Absolute Creative Print requires reasonable time to complete the work requested by the client, which will be discussed at the beginning of each project. 

10.2  If timings need to be adjusted for any reason, Absolute Creative Print will inform the client within reasonable time,

10.3  Absolute Creative Print makes every effort to achieve the agreed delivery dates and cannot accept liability of be held financially responsible for any deadlines missed resulting from extenuating circumstances:

  • Content supplied to Absolute Creative Print after the agreed times

  • Other parties that are unable to fulfil their agreed delivery times

  • Act of God or any extraordinary incidents beyond the control of Absolute Creative Print, including fire, droughts or floods

  • Sickness or personal injury

  • War or acts of terrorism

  • Theft, damage or loss of equipment, documents or any items that are required to fulfil the expectations of the project

  • Legislation

  • Failure of power supply

  • Strike action taken by persons, parties and services required to complete the work

  • Epidemics or pandemics, for example: the recent COVID-19 pandemic


11.0. Intellectual Property.

11.1  All work, both physical, digital and intellectual is the property of Absolute Creative Print until the final payment has been received.

11.2  If final payment is not made, or the project has been cancelled before completion and full payment, designs will remain the property of Absolute Creative Print, who reserve the right to reuse or amend any ideas.

11.3  Once the project is signed off and paid in full, the high resolution files will be provided to the client. If the client requires these files for transfer to another designer, they will be subject to a separate quotation or ‘buy out’ charge.

11.4  If a choice of designs are provided and one is chosen for your project, only that solution will be deemed to be supplied by us as fulfilling the contract. 

11.5  Any unused designs will remain the property of Absolute Creative Print, unless specifically agreed in writing. 

11.6  Absolute Creative Print will always endeavour to create original work will not accept liability for any alleged claim of unintentional similarities between the work undertaken and third party property.

11.7  Absolute Creative Print cannot guarantee exclusivity for any strategy, design or concept provided to the client.  

11.8  Absolute Creative Print reserves the right to use any concepts and designs for the purposes of marketing activities, both online and offline, unless otherwise agreed with the client.

11.9  It is not permitted for any person to copy, use or reproduce any work or content created by Absolute Creative Print, including content from this website or any form of correspondence with Absolute Creative Print, without the written content of Absolute Creative Print.


12.0. Cancellations.

12.1  Absolute Creative Print will endeavour to create the best possible work for the client in any given project. Due to the varying nature of creative work, timescales and machinery the output can vary. By agreeing to work with Absolute Creative Print, the client understands the skills and work ethic that Absolute Creative Print provides. If the client is unsatisfied with the work produced under this agreement, Absolute Creative Print will attempt to reach a favoured solution for all parties.

12.2  Absolute Creative Print reserves the right to request payment for the time spent on the project up until cancellation and are non-refundable. Records of time are kept for each project undertaken.


13.0. Disputes.

12.1  If the client has any disputes before, during or after a project, they are advised to contact Absolute Creative Print in writing via email to ensure any issues are resolved efficiently and in an appropriate manner.

12.2  Any claims that are made against Absolute Creative Print are limited to the amount of the total payment made to Absolute Creative Print by the client.


14.0. liability

14.1  Absolute Creative Print will take appropriate care to ensure the security and safety of any physical and/or intellectual property belonging to the client. Absolute Creative Print also puts emphasis on the care and consideration for the mental and physical wellbeing of any persons in work undertaken.

14.2  Absolute Creative Print will not accept liability for any of the following:

  • Any errors or issues with content and imagery supplied to Absolute Creative Print by the client

  • Spelling or grammatical errors in content that has been supplied to Absolute Creative Print by the client

  • Theft, damage or loss of any information or physical items belonging to the client, or any persons involved in, or resulting from, work undertaken by Absolute Creative Print

  • Any damages to physical work with third party couriers

14.3  Any changes that are required after the final sign-off may incur extra costs. These will be discussed and outlined in writing with the client before proceeding.


15.0. THE LEGAL BIT.

15.1  This agreement indemnifies Absolute Creative Print in respect of any claims, costs and expenses arising out of any libellous matter or any infringement of copyright, patent, design or of any proprietary or personal rights contained in any material published (both online and offline) for the client. The indemnity shall extend to any amounts paid on a lawyer’s advice in settlement of any claim.

15.2  Absolute Creative Print reserves the right to change the Terms and Conditions at any time, without prior notice given.

15.3  These terms and conditions, and use of this website, shall be governed by and construed in accordance with the law of England.


16.0. Recurring Payments.

16.1  Absolute Creative Print will take a recurring payment through our merchant service once we have been authorised. These payments will be taken for goods and services we have produced.

16.2  Payments will only be taken when the customer has confirmed pricing and authorised the transaction.

16.3  The payment will be taken when the goods or services have been produced and will be on an agreed date.

16.4 The payment will be due on the day of the order.

16.5 You are able to cancel your recurring payment at any time.
